The Customer is the private individual or company as specified in section 1 of the Dealer Car Agreement. The Supplier is the company named at the top of the Dealer Car Agreement. The Vehicle is the vehicle described in the ‘Vehicle Details’ section of the Dealer Car Agreement.
1. In accepting this vehicle I acknowledge that it is your property and it is provided to me on loan subject to the following conditions:
2. I am responsible for arranging and maintaining at my expense Comprehensive insurance cover for the vehicle whilst in my possession and will provide proof of cover.
3. I accept full responsibility for any uninsured loss or damage however such loss or damage caused. In the event of an accident I will report the incident immediately to the bodyshop and will complete an accident report from at the bodyshop. Any necessary repair work will be carried out by the bodyshop and paid by me upon receipt of invoice.
4. I am over 21 and under 81 years of age, suffer from no physical or mental impairment affecting my ability to drive and have held a valid UK driving licence applicable to the vehicle for at least 12 months. I have not accumulated more than 9 penalty points in the last 3 years, nor have I been disqualified from driving in the last 5 years.
5. I accept that any motoring or traffic offences, toll charges, penalties and fines arising in relation to the vehicle for the duration of the loan are my sole responsibility under the Road Traffic Regulation Act 1984, the Road Traffic Offenders Act 1988, and/or any subsequent relevant legislation. I will indemnify the bodyshop forthwith for any penalties, fines, legal fees,cost, interest or other charges paid by them in relation to any such motoring or traffic offences or toll charges. I hereby irrevocably consent to any such charges including an administration fee of £25 plus vat being charged to this credit card:
6. I will not drive the vehicle more than the allowable daily mileage unless by prior agreement. If I do I will accept a charge of £1.34 plus VAT per mile in excess of the agreed mileage.
7. I will replace all fuel used during the loan period, or be invoiced for it at a cost of £1.40 plus VAT per litre. I will pay for any loss/damage as a result of not using the correct fuel.
8. I agree that the vehicle is only insured to be driven by the person(s) named above who have signed this form and will only be used for social, domestic and pleasure purposes and/or for my own business purposes excluding use for hire and reward, taxi or courier business purposes. I will indemnify the bodyshop in full against any and all claims, costs and expenses arising out of driving the vehicle by any other persons.
9. I will not enter into any other agreement with any third party to further hire or loan the vehicle.
10. I understand the vehicle’s controls, agree not disengage any of the passive safety features and to leave it secured at all times with the keys removed. I understand that failure to do so will leave me fully liable for the value of the vehicle.
11. I agree not to use the vehicle for towing, track or off road purposes, and not to take the vehicle outside the UK and Eire.
12. I will return the loan vehicle at the end of the agreed loan period, or whenever requested and agree to pay £50 plus vat per day if the vehicle is not returned within 1 hour of the agreed time, plus a storage charge of £25 plus vat per day for any vehicle left upon the bodyshop premises.
13. I will not smoke or allow animals in the vehicle and I will return the vehicle in a clean and serviceable condition, and agree to pay £50 plus VAT for cleaning if required.
